FAQ

How long does it take to evict a tenant after a TAL judgment?

The timeline varies depending on the decision issued by the Tribunal administratif du logement (TAL) and the nature of the judgment. In general, a tenant has 10 days to vacate the premises voluntarily after the judgment is served.
After this period, we can proceed with the eviction with the necessary authorization. However, urgent cases may be handled more quickly.

What happens to the tenant’s belongings during an eviction ?
If the tenant has not vacated the premises, their belongings are generally stored in a designated facility (public warehouse) at their expense. Under no circumstances may the landlord dispose of the tenant’s personal belongings themselves. We ensure that the inventory and transfer of the items are carried out legally and securely.
Can I evict a tenant myself without a court judgment ?
No. In Québec, only a decision from the Administrative Housing Tribunal followed by a formal eviction process carried out by a bailiff is legal. Any eviction carried out without a judgment (or without a bailiff) is considered illegal and may result in penalties against the landlord.
